Someone will probably beat me to this response :-( but I suspect this is just an unavoidable consequence of the way the embed content page works e.g. it's creating a browser window above the Xerte Flash window and it has to be above for it to show whatever is embedded so I suspect the Xerte Contents menu is still working but below the browser window. But I'd say the benefits far outweigh that minor issue?

I have used the latest version of embedDiv.rlm from the templates/pageTemplates/models folder of the xerte svn to update my xerte install.
Both in an individual page template project and in a pageTemplates project I have found that whilst the embedDiv page works, for some reason when the published project is viewed in Opera or IE8 when you view the embedDiv page the xerte contents menu ceases to operate.
To test create a project with a title page and an embedDiv page with a valid url.
When viewing the title page you will be able to open the xerte contents menu.
Then go to the embedDiv page - now the contents menu will cease to operate.
Now return to the title page - contents menu works again.
