The HTML4 stuff might seem like a bit pointless but at least it will render the path down the mountain in the data560.xml (in case that is still going to be used as a demo) in IE and the HTML5 stuff will take precedent in the other browsers. I'll have to speak to Fay about IE because just now IE8 document compatibility is forced which means that IE9 HTML5 supported tags can't be used even if the user has IE9.
