Open Source does not always mean free of cost or free from restriction on
use.

The Open Source JW FLV Player can be downloaded from

http://www.longtailvideo.com/players/jw-flv-player

However by downloading the player you are committing to the non-commercial
licence which includes the text

"Noncommercial — You may not use this work for commercial purposes."

I am no legal expert but I think that the following would probably apply:

   1. Including the player in Xerte or XOT would not be in breach of the
   licence as long as the attribution terms of the licence were met.
   2. Any user of Xerte or XOT who used the JW FLV Player in their learning
   object would have to buy a commercial licence if for example they charged
   fees for the education they provided.


However it might be possible to get a waiver of some of the terms of the
licence from the copyright holder. This may be what moodle did. It is some
time since I looked "under the bonnet" at moodle but they used to supply an
early version of the JW FLV Player as part of the Moodle install.
